How and why will your data be processed?

Your data – with reference to each specific purpose – will be processed as follows

BESTOWAL -  In all those cases in which we ask for consent to the processing of your personal data, their provision is purely optional. Consequently, failure to provide your personal data will have no consequences, except in terms of the impossibility of processing the data for these specific purposes. -  In all other cases in which we do not require consent to the processing of your personal data, their provision is instead mandatory and necessary to comply with contractual or legal provisions and for the purposes of the proper performance of the company's business. Consequently, failure to provide data would not make it possible to comply with these requirements and carry out the company's activities correctly. -  If the interested party is a legal person, I.T.C. does not consider it necessary to come into possession of personal data relating to its representatives or collaborators; However, in the knowledge that the characteristics of the email address entered during registration (for example, consisting of the string name.surname), may lead to the occurrence of this circumstance, it will also process such data in the manner indicated in this policy that the user therefore undertakes to deliver to all its representatives / collaborators who, for the reasons highlighted above,  transmit their personal data to I.T.C.
CATEGORIES OF RECIPIENTS Personal data will not be passed on to recipients other than the Data Processors.
AUTOMATED DECISION-MAKING PROCESSES There are no automated decision-making processes.
TRANSFERS OUTSIDE THE EU OR INTERNATIONAL ORGANIZATIONS Some Data Processors may transfer your data to non-EU countries, subject to verification by us of the existence of appropriate guarantees.
LEGITIMATE INTERESTS OF THE DATA CONTROLLER The legitimate interest of the data controller indicated for the purposes referred to in number M2: it is the correct and smooth functioning of the site S: it is the correct and safe conduct of the company's business.

What will your rights be?

You may exercise the following rights by sending a specific request to the Data Controller at the following e-mail address:

ACCESS (cf. Article 15 GDPR) The right to have confirmation of the existence or otherwise of the processing and to access the data and information relating to: the purpose of the processing, the categories of data processed, any recipients, any transfers and any adequate guarantees, the retention period, the rights of the data subject, the possible existence of an automated decision-making process. The Data Controller provides a copy of your personal data. If the request is made by electronic means, and unless otherwise specified, the information shall be provided in a commonly used electronic format.
RECTIFICATION (cf. Article 16 GDPR) Right to obtain the rectification of inaccurate personal data and the completion of incomplete personal data.
CANCELLATION (cf. Article 17 GDPR) Right to obtain erasure of personal data concerning you if: they are no longer necessary in relation to the purposes, you withdraw your consent (and there is no other legal basis for the processing), you object to the processing on grounds relating to your particular situation (and there is no overriding legitimate ground), you object to the processing for direct marketing purposes,  Personal data is processed unlawfully, must be erased in order to comply with a legal obligation, has been collected in connection with the provision of information society services. The right does not apply if the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for the performance of a task carried out in the public interest or in the exercise of official authority, for reasons of public interest in the field of health, for archiving purposes in the public interest,  scientific or historical research or for statistical purposes, for the establishment, exercise or defence of legal claims.
LIMITATION (cf. Article 18 GDPR) Right to request the storage of the data only if: the data subject has contested the accuracy of the data (for the period necessary to verify its accuracy), the processing is unlawful (but the data subject has requested the restriction instead of the deletion), the data are necessary for the data subject in court and, although the data controller no longer needs it, has exercised the right to object (while the data controller verifies the existence of legitimate and overriding reasons)
OPPOSITION (cf. Article 20 GDPR) Right to object to processing of your data if (i) it is based on public interest or legitimate interest and (ii) if the data is processed for direct marketing purposes, including profiling.
PORTABILITY (cf. Article 21 GDPR) Right to receive data in a structured format (only for automated processing).
WITHDRAWAL OF CONSENT (cf. Article 13(2)(d) Right to withdraw consent at any time, where provided for as a legal basis, without prejudice to the lawfulness of the processing based on it before its withdrawal.
COMPLAINT (cf. Article 13(2)(d) Right to lodge a complaint with the Data Protection Authority for any alleged violation of the GDPR.
